Information in compliance with personal data protection regulations

Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, relating to the protection of natural persons with regard to the processing of personal data and the free circulation of these data and by which Directive 95/46/EC (General Data Protection Regulation) (OJEU L 119/1, 04-05-2016) (hereinafter, GDPR) is repealed, providing a modernized and accountability-based framework for the data protection in Europe. In this sense, article 12 of the RGPD, under the heading “Transparency of information, communication and methods of exercising the rights of the interested party”, establishes the following in section 1:

The controller shall take the appropriate measures to provide the data subject with all the information indicated in articles 13 and 14, as well as any communication pursuant to articles 15 to 22 and 34 regarding the treatment, in a concise, transparent, intelligible and easy way. access, in clear and simple language, in particular any information directed specifically at a child. The information will be provided in writing or by other means, including, if applicable, by electronic means. When requested by the interested party, the information may be provided verbally provided that the identity of the interested party is demonstrated by other means.

In order to make compatible the greater information requirement that the RGPD introduces and the conciseness and understanding in the way of presenting it, from the Data Protection Authorities it is recommended to adopt an information model by layers or levels.
